Terms of Service

These Terms of Service ("Terms") govern your use of the SignStream Pro service operated by TradeStream Marketing Corp ("we", "us") at SignStreampro.com (the "Service"). By creating an account or using the Service, you agree to these Terms.

1. The Service

SignStream Pro is a software-as-a-service platform for contractors and small businesses to create, send, and track estimates and invoices, collect electronic signatures, and accept payments.

2. Accounts

You must be at least 18 years old and provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your password and for all activity under your account.

3. Plans, Trials, and Billing

The Free plan is available at no charge and does not require payment information. Paid plans (Pro and Business) include a 14-day free trial. After the trial, you will be charged the monthly or annual fee for the plan you selected unless you cancel before the trial ends. Paid plans renew automatically until cancelled. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period and no refunds are issued for partial periods unless required by law.

4. Customer Communications

The Service sends emails and SMS messages on your behalf to the recipients you designate (your clients). You represent and warrant that:

You are solely responsible for the content of messages you send through the Service and for any consequences arising from those messages. We may suspend or terminate accounts that send unsolicited or non-compliant messages.

4a. SMS Notifications Program Terms

Program name: SignStream Pro SMS Notifications.

Program description: When a contractor using the Service chooses to send an estimate, invoice, or change order to a customer by text message, SignStream Pro delivers a single transactional SMS on the contractor's behalf. The message contains the contractor's company name, document number, total amount, and a secure link to review, sign electronically, and pay. Customers may also receive a payment-receipt SMS after they pay, and occasional reminder SMS if a signed document remains unpaid. No marketing or promotional SMS is sent.

How customers opt in: Customers provide their mobile phone number directly to the contractor in person, by phone, or through a web form when requesting a quote or service. The contractor enters the phone number into the Service on the customer's behalf. By giving the contractor the phone number for the purpose of receiving their estimate or invoice, the customer consents to receive these transactional SMS messages from SignStream Pro on the contractor's behalf.

Message frequency: Message frequency varies depending on the contractor's workflow and the specific job. Customers typically receive between 1 and 5 messages per service request (estimate delivery, signed-document confirmation, payment receipt, and occasional payment reminders).

Message and data rates: Message and data rates may apply. Carrier rates are determined by the customer's mobile carrier and are not controlled by SignStream Pro.

How to opt out: Customers can reply STOP to any message at any time to immediately unsubscribe from all further SMS from the contractor's account. Reply HELP for assistance, or contact support@SignStreampro.com.

5. Customer Data

You retain ownership of all client and document data you enter into the Service. You grant us a limited license to host, process, and transmit that data solely to provide the Service. You are responsible for complying with applicable privacy laws regarding the data you collect from your own customers.

6. Acceptable Use

You may not use the Service to: (a) violate any law; (b) infringe intellectual property rights; (c) send spam or harassing messages; (d) attempt to disrupt or compromise the Service or its users; (e) reverse engineer or copy the Service.

7. Termination

You may close your account at any time. We may suspend or terminate your account if you breach these Terms or use the Service in a way that creates legal or operational risk. On termination, your access to the Service will end and your data may be deleted after a reasonable retention period.

8. Disclaimer

The Service is provided "AS IS" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that messages will always be delivered (carriers may filter or block messages outside our control).

9. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claim arising from your use of the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.

10. Changes

We may update these Terms from time to time. Material changes will be communicated via email or in-app notice. Continued use of the Service after a change constitutes acceptance of the new Terms.

11. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of laws principles. Any dispute will be resolved in the state or federal courts located in Broward County, Florida.
